A lease deed is the formal legal document that records a rental arrangement between a property owner and a tenant. In Delhi, if your lease runs for more than 11 months, registering this deed at the Sub Registrar Office is not just recommended - it is legally required under the Registration Act, 1908.

But even if your lease is for 11 months or less, registration gives you something valuable: the document becomes admissible as primary evidence in court. An unregistered agreement, no matter how well-drafted, can only serve as collateral evidence - a weaker position if disputes arise.

When is Lease Deed Registration Mandatory in Delhi?

  • Lease above 11 months: Registration is compulsory. An unregistered lease of this duration has no legal standing as primary evidence.
  • Lease of 11 months or less: Registration is optional but recommended for high-value properties or commercial spaces.
  • Renewal of existing lease: If the renewed term pushes the total beyond 11 months, registration becomes necessary for the new agreement.

Which SRO Do You Go To?

Delhi has multiple Sub Registrar Offices, each covering specific areas. You must visit the SRO that has jurisdiction over the property's physical location - not where the landlord or tenant lives. For example, if the property is in Dwarka, you go to the SRO covering Dwarka, even if the landlord resides in East Delhi.

Major SRO locations in Delhi include offices in Hauz Khas, Janakpuri, Shahdara, Rohini, Civil Lines, and Mehrauli among others. You can verify the correct SRO for your property through the Delhi Revenue Department website.

The Registration Process - Step by Step

1 Prepare the Lease Deed Document

The deed should contain complete details of both parties (name, father's name, address, Aadhaar number), full property description (address, floor, flat number, area), rent terms (amount, escalation, payment date), security deposit, duration, and all agreed clauses. 2 Procure E-Stamp Paper of Correct Value

Calculate the stamp duty based on your lease duration and average annual rent. Purchase the e-stamp certificate from an SHCIL authorized centre or designated bank. The deed is then printed on this e-stamp paper. Double-check the value - insufficient stamping can invalidate the document.

3 Get All Signatures

Both the landlord (or authorized representative with Power of Attorney) and the tenant sign the deed. Two independent witnesses also sign. Each person signs on every page of the document, not just the last page. Witnesses should ideally not be family members of either party.

4 Book an Appointment at the SRO

While walk-ins are sometimes possible, booking an appointment through the Delhi e-District portal saves significant waiting time. Select the correct SRO based on your property's location. Appointments are typically available within a few days.

5 Visit the SRO - What to Carry

Everyone must be present in person. Carry:

  • Signed lease deed on e-stamp paper (original + 2 photocopies)
  • Aadhaar Card of landlord, tenant, and both witnesses (original + copy)
  • Property ownership proof - Sale Deed, Allotment Letter, or latest Property Tax receipt
  • 2 passport-size photographs of each person
  • PAN Cards of landlord and tenant
  • Registration fee of Rs.1,100 (cash or demand draft - check with your SRO)
6 At the SRO - The Actual Process

The Sub Registrar or their staff will verify all documents, check the e-stamp certificate authenticity, and confirm the identities of all parties. Biometric data (fingerprints and photographs) of the landlord, tenant, and witnesses is captured digitally. The registration fee is collected. The Sub Registrar then endorses the document, making it officially registered.

7 Collect the Registered Copy

After endorsement, the SRO retains one copy and returns the original to you. Processing time varies - some SROs return the document the same day, others may take 1-2 weeks. You will receive a registration number that can be used to verify the document's authenticity in the future.

Wrong SRO

Missing Witnesses

E-stamp value does not match the calculated duty. You will need to purchase a fresh e-stamp of the correct amount.

No Property Proof
