What is a Lease Deed?

A lease deed is a registered legal document that transfers the right to use and occupy an immovable property from the owner (lessor) to the tenant (lessee) for a fixed term of one year or more, against rent. In Delhi, lease deeds are compulsorily registrable at the Sub Registrar Office under Section 17(1)(d) of the Registration Act, 1908.

Lease deeds are the standard instrument for long-term residential lets, shop and office premises, warehouses, institutional buildings, and 33/99-year plot leases. Unlike an 11-month rent agreement, a registered lease deed gives both parties court-enforceable rights over the full term - rent escalation, lock-in period, renewal option and eviction terms all become binding.

Lease Deed Stamp Duty in Delhi (2026)

Stamp duty is charged on the average annual rent (total rent across the term divided by number of years), as per the Indian Stamp Act slabs applicable in Delhi:

What if You Skip Registration?

Section 49, Registration Act: an unregistered lease above 11 months cannot prove its own terms - rent escalation, lock-in and eviction clauses all become unenforceable.

Courts treat the occupant as a month-to-month tenant under Section 106, TPA - your 5-year lease effectively shrinks to 30-day notice periods.

Banks, GST registration and government tenders require a registered lease for business address proof - unregistered deeds get rejected.
