Why NRIs Need Professional Help With Delhi Property

Owning property in Delhi while living abroad creates a specific set of problems: you can't sign documents in person, you can't sit at the Sub Registrar Office, you can't personally chase a tenant for rent, and every trip back to India to "sort out the property" costs time, money, and leave you don't have. A properly executed Power of Attorney (POA) solves the legal side - roughly 28% of all NRI property transactions in India already use this route. The part that trips most NRIs up isn't the POA itself - it's getting the paperwork (apostille/attestation, adjudication, timing) right the first time.

The 3-Month Stamping Deadline - Don't Miss This

Section 18, Indian Stamp Act, 1899

A POA (or any instrument) executed outside India must be stamped - "adjudicated" - within 3 months of the date it FIRST reaches India. Not from the date you signed it abroad. If this window is missed, the document can be impounded and a penalty charged before it can be used for registration or anything else.

This is exactly where most NRI cases run into trouble - the POA gets couriered to a family member in India, sits in a drawer for a few months while everyone figures out next steps, and by the time someone tries to use it, the window has closed. If your POA has already reached India, treat this as urgent.

Apostille or Embassy Attestation - Which One Do You Need?

Before a POA signed abroad is valid for use in India, it needs to be authenticated in the country where you signed it. Which process applies depends on whether that country is part of the Hague Apostille Convention:

Your Country is...What's Needed
Hague Convention member
e.g. USA, UK, Canada, Australia, Germany, UAE, Singapore
Apostille from the local competent authority (e.g. Secretary of State, Foreign Ministry)
Not a Hague Convention memberAttestation by the Indian Embassy / Consulate in that country

Not sure which category your country falls into, or which local office issues the Apostille? Message us on WhatsApp with your country and we'll confirm the exact steps for you.
